Terms of service

Welcome to Spike. Spike for YouTube is a software service that watches YouTube channels you add and tells you when a new upload crosses a view threshold inside a time window you set. These terms (the “Terms”) are a binding agreement between you and Artem Starostenkov, a sole proprietor in Poland trading as Artem Starostenkov Software (NIP 9512459479) (“Spike”, “we”, “us”). By creating an account or otherwise using the service, you agree to these Terms and to our privacy policy. If you do not agree, do not use Spike.

If you are using Spike on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Spike watches YouTube channels you choose. You set a view count and a time window. When a new upload on a watched channel crosses that line, the event appears in your dashboard. You can optionally receive a signed HTTPS webhook, call a REST API, and export recent events. You pay for how many channels you watch, not for how many events we send.

You do not bring YouTube API keys. A tracker polls the channels you add and reads publicly available metadata — channel and video titles, thumbnails, publish times, and public view counts. We do not search YouTube as a whole.

We may add, change, suspend, or remove features and impose reasonable usage limits to keep the service stable or to respond to YouTube, payment providers, technical restrictions, or legal requirements.

• You must be at least 16 years old and able to enter a binding contract.
• You are responsible for everything that happens under your account, including email codes, an optional password, API keys, and webhook signing secrets.
• One person, one account. Do not create extra accounts to bypass channel limits.
• You must give us an accurate email address and update it if it changes.

Spike is offered on a temporary free trial (currently 3 channels for 7 days, live webhooks, no credit card) and on paid monthly plans. Plan limits, prices, and features are shown on the pricing page. The trial may change or go away.

• Subscriptions renew automatically until cancelled.
• You can cancel at any time from Billing; cancellation takes effect at the end of the current period.
• Fees are non-refundable except where required by law. We may, at our discretion, offer a refund for a serious service failure.
• Taxes are your responsibility unless we are required to collect them.
• If a payment fails, we may pause watches, webhooks, and other paid features until the issue is resolved.
• If we materially raise prices, we will give you at least 30 days’ notice before the change applies to your account.
• If a trial or subscription is not live, watches and deliveries pause.

You agree not to:

• Use Spike for anything illegal, abusive, deceptive, or that infringes someone else’s rights.
• Use Spike to scrape, mirror, or republish YouTube content outside normal product use (your dashboard, exports, API, and webhooks you control).
• Reverse engineer, decompile, or attempt to extract source code from the service.
• Attempt to access another user’s account or data, probe our infrastructure, or interfere with the service’s availability or integrity.
• Point webhooks at systems you do not control, or use deliveries to attack or overload a third party.
• Resell, sublicense, or redistribute the service.

We may suspend or terminate accounts that violate these rules, with or without notice.

Spike is not affiliated with, endorsed by, or sponsored by YouTube or Google. YouTube content stays owned by its authors and other rights holders. Access through Spike does not give you a separate right to copy, republish, resell, or redistribute that content.

You must follow the YouTube Terms of Service. Use of YouTube through or alongside Spike is at your own risk. YouTube’s Google Privacy Policy also applies to data Google holds about you.

We do not guarantee that we will catch every upload or every threshold crossing, or that a hit will arrive within a given time. We depend on publicly available YouTube data, rate limits, and our tracker. If YouTube changes, restricts, or breaks access, we will make reasonable efforts to restore the product, and we may disable or replace features.

You retain all rights to the content you create inside Spike (projects, watches, names, descriptions). You grant us the limited rights needed to host and operate the service for you. We will not use that content for any other purpose.

Public YouTube metadata we retrieve remains owned by the original authors or other applicable rights holders. We display it as part of the monitoring service and may remove or limit it when required by law, a rights holder, YouTube, or our policies.

If you add a webhook, we POST event JSON to the public HTTPS URL you give us. The payload includes your watch and project identifiers plus public YouTube metadata for the hit. You are responsible for that endpoint and for anyone who receives the payload. We store delivery status, attempt count, last HTTP status, and a short error — not your response body.

API keys can read watches and events on the account. Keep keys and signing secrets secret. You can revoke them in the dashboard. Docs for both surfaces are on the docs page.

Spike, the Spike name and logo, the dashboard, and the underlying software are owned by Artem Starostenkov and protected by intellectual property laws. Subject to these Terms we grant you a limited, non-exclusive, non-transferable right to access and use the service for your own monitoring.

If you send us feedback, ideas, or suggestions, we may use them without obligation to you. We will not publicly attribute feedback to you without your permission.

You can deactivate your account from settings. Watches and webhook delivery stop. We keep the account so it can be restored later — see the privacy policy. Email direct@spike.yt if you want the account deleted.

We may suspend or terminate your account if you violate these Terms, if your use creates risk or legal exposure for us, or if you stop paying for a paid plan. On termination, your access ends and we handle stored data as described in the privacy policy.

Spike is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, or completely secure. We do not guarantee that every relevant upload will be retrieved, or that a threshold hit will be recorded or delivered within a given time.

To the maximum extent permitted by law, Spike will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or in connection with the service. Our total liability for any claim arising out of or relating to these Terms or the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

You agree to indemnify and hold Spike and its operators, officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the service, your webhooks or API consumers, your content, your violation of these Terms, or your violation of any third party’s rights or applicable law.

These Terms are governed by the laws of Poland, without regard to conflict of law rules.

We may update these Terms from time to time. If we make material changes we will notify you by email or in-product banner at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
